Copyright (DMCA) Policy

Legal agreements and policies for creators using CleerCut.

Introduction

CleerCut respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (17 U.S.C. §512). This policy outlines the process for submitting copyright infringement notices and counter-notices. CleerCut has designated a copyright agent to receive DMCA notices.

1. Filing a DMCA Takedown Notice

If you are a copyright owner or authorized agent and believe that content hosted on CleerCut infringes your copyright, you may submit a written DMCA notice containing the following information:

  • Your full legal name and contact information, including email address
  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the allegedly infringing material, including the specific URL or location on the Platform
  • A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
  • A statement that the information in the notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner
  • Your physical or electronic signature

CleerCut will respond expeditiously to valid notices by removing or disabling access to the allegedly infringing content.

2. CleerCut's Response to Takedown Notices

Upon receipt of a valid DMCA notice, CleerCut may:

  • Remove or disable access to the allegedly infringing material
  • Notify the user who posted the material
  • Provide the user with an opportunity to submit a counter-notice

CleerCut reserves the right to remove content that it determines, in its discretion, violates intellectual property rights or applicable law.

3. Filing a Counter-Notice

If your content was removed or disabled and you believe this occurred due to mistake or misidentification, you may submit a counter-notice including:

  • Your full legal name and contact information
  • Identification of the material that was removed and its prior location
  • A statement under penalty of perjury that you have a good faith belief the material was removed due to mistake or misidentification
  • A statement consenting to the jurisdiction of the federal court in the district where you reside (or, if outside the United States, consenting to jurisdiction in a United States federal court)
  • Your physical or electronic signature

If CleerCut receives a valid counter-notice, we may restore the content unless the original complainant files a court action within ten business days after receiving notice of the counter-notice.

4. Repeat Infringer Policy

CleerCut maintains a policy for terminating accounts of repeat infringers in appropriate circumstances. CleerCut may, in its discretion, determine whether a user qualifies as a repeat infringer based on the number and validity of infringement claims within a given period. Accounts determined to be repeat infringers may be suspended or permanently terminated.

5. Misrepresentation

Under 17 U.S.C. §512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material was removed by mistake or misidentification, may be subject to liability. CleerCut reserves the right to pursue appropriate action against parties who submit false or abusive infringement claims.

6. Limitation of Liability

CleerCut complies with the DMCA safe harbor provisions and is not liable for content posted by users. Users are responsible for ensuring that their uploaded content does not infringe intellectual property rights. By using the Platform, users agree to indemnify CleerCut for claims arising from content they upload.

7. Modifications

CleerCut may update this DMCA Policy at any time. Continued use of the Platform constitutes acceptance of the current version.
