Global Data Processing Agreement

Legal agreements and policies for brands and agencies using CleerCut.

Introduction

This Data Processing Agreement (DPA) forms part of the CleerCut Client Agreement and applies when CleerCut processes Personal Data on behalf of users. By using the CleerCut platform, users agree to this Data Processing Agreement.

1. Roles of the Parties

The user of the CleerCut platform acts as the Data Controller. CleerCut acts as the Data Processor. CleerCut processes Personal Data solely to provide and operate the platform services.

2. Types of Data Processed

CleerCut may process Personal Data including account information, contact details, campaign and collaboration data, communication records within the platform, billing records, and usage and technical data.

3. Purpose of Processing

CleerCut processes Personal Data to provide and operate the platform, facilitate collaborations between Creators and Clients, enable platform communication and campaign management, process payments through third party providers, and maintain platform security and fraud prevention.

4. Subprocessors

CleerCut may engage third party service providers including cloud hosting infrastructure, payment processing, and security and analytics tools. CleerCut requires such subprocessors to implement appropriate data protection safeguards.

5. Security Measures

CleerCut implements reasonable technical and organizational safeguards including encryption of data in transit, access controls, infrastructure security monitoring, and security incident response procedures.

6. Data Subject Requests

Where required by applicable law, CleerCut will assist users in responding to requests regarding Personal Data including access, correction, deletion, and restriction of processing. Requests may be submitted to hello@cleercut.com.

7. Data Retention

CleerCut retains Personal Data only for as long as necessary to provide services and comply with legal obligations, as described in the CleerCut Data Retention Policy.

8. International Data Transfers

CleerCut may transfer Personal Data to service providers located in different jurisdictions. Where required by applicable law, CleerCut will implement appropriate safeguards to protect such transfers.

9. Security Incidents

In the event of a security incident affecting Personal Data, CleerCut will investigate, take reasonable steps to mitigate the impact, and notify affected users when required by applicable law.

10. Governing Terms

This Data Processing Agreement forms part of the CleerCut Client Agreement. If any conflict exists between this DPA and the Client Agreement, the Client Agreement will govern unless otherwise required by law.
