Copyright (DMCA) Policy

Legal agreements and policies for brands and agencies using CleerCut.

Introduction

CleerCut respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (17 U.S.C. §512). This policy outlines the process for submitting copyright infringement notices and counter-notices.

1. Filing a DMCA Takedown Notice

If you are a copyright owner or authorized agent and believe that content hosted on CleerCut infringes your copyright, you may submit a written DMCA notice containing:

  • Your full legal name and contact information, including email address
  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the allegedly infringing material, including the specific URL or location on the Platform
  • A statement of good faith belief that the use is not authorized by the copyright owner, its agent, or the law
  • A statement that the information is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner
  • Your physical or electronic signature

2. CleerCut's Response

Upon receipt of a valid DMCA notice, CleerCut may remove or disable access to the allegedly infringing material, notify the user who posted the material, and provide the user with an opportunity to submit a counter-notice.

3. Filing a Counter-Notice

If your content was removed and you believe this occurred due to mistake or misidentification, submit a counter-notice including your name and contact information, identification of the removed material, a statement under penalty of perjury of good faith belief it was removed in error, consent to jurisdiction, and your signature. Counter-notices must be submitted to: hello@cleercut.com (Attn: Designated DMCA Agent).

4. Repeat Infringer Policy

CleerCut maintains a policy for terminating accounts of repeat infringers in appropriate circumstances. Accounts determined to be repeat infringers may be suspended or permanently terminated.

5. Misrepresentation

Under 17 U.S.C. §512(f), any person who knowingly materially misrepresents that material is infringing may be subject to liability. CleerCut reserves the right to pursue action against parties who submit false or abusive infringement claims.

6. Modifications

CleerCut may update this DMCA Policy at any time. Continued use of the Platform constitutes acceptance of the current version.
